New publication: International Commercial Courts “Made in Germany”



In October 2024, the German legislature passed the Act to Strengthen the Judicial System. It allows the federal states to establish special tribunals for high-volume commercial disputes (known as commercial courts) at selected higher regional courts, which, at the request of the parties, have jurisdiction in the first instance and may conduct proceedings entirely in English. In an article just published in the Journal of Law and Commerce, Professor Rühl and Nicolas Dewitte Langenfeld (doctoral candidate at the DFG Research Training Group DynamInt) place the law in its national and international context and ask whether international arbitration faces serious competition from the German commercial courts.
