Conference: „The Future of Law: Technology, Innovation and Access to Justice“

Access to Justice is commonly understood as the ability for ordinary people to have the wherewithal to address their everyday legal problems. It is estimated that globally around 4 billion people live outside the scope and reach of the law, and do not have the security, opportunity or protection to redress their grievances and injustices. Access to justice can be seen as an expansive concept and has symbolic, financial, informational and structural implications for fights against poverty, inequality, violence and a lack of development. This significance has been recognized in the sustainable development goals that see access to justice as a key driver for building peaceful and inclusive societies. At the same time, technology is increasingly having an impact on the law. “Legal Tech” is starting to have an impact on all stakeholders in the legal industry including by reimagining the nature of legal services, encouraging data driven litigation, enabling alternative and online dispute resolution forums, developing preventative lawyering, introducing new curriculum in legal education and financing of legal aid. How can we harness legal technology to promote access to justice in courts, educational institutions, goverment? What are the challenges in a development context? And how do we properly address privacy issues in this context that form a natural side-effect of technological development today? In searching for answers these question, the Chair for Public and Comparative Law, Humboldt University of Berlin and the Friedrich Naumann Foundation for Freedom are bringing together leading experts from around the world as part of a two-day expert conference on the “Future of the Law: Technology Innovation and Access to Justice”. Öffentlicher Vortrag von Prof. Ratna Kapur (Queen Mary University of London) "Shaping the 'Other' Woman in Law: Gender Equality, Secularism, and the Rise of Hindu Nationalism"

Professor Kapur's talk focuses on how different conceptions of gender are shaped in and through judicial understandings of gender equality secularism and freedom of religion in relation to the 'Other.' She unpacks how recent legal contests over the meaning of equality, in particular gender equality in relation to Muslim women, are advancing a model of secularism based on Hindu majoritarianism and shaping a very specific notion of gender tied to Hindu nationalism. The talk examines the implications of setting up religion (of the minority community) invariably in opposition to gender equality in both feminist and progressive legal advocacy as well as the advocacy of the Hindu Right, and how this ultimately obscures the majoritarian underpinnings and normative scaffolding of the right to gender equality, religion and secularism. The courts are implicated in advancing the Hindu Rights use of gender equality to position itself as a saviour of Muslim women, who are cast as victims in need of rescue from what it claims is the discriminatory and subordinating treatment by Muslim men. In the process, it not only further demonises Muslim men, but also advances its goal of establishing a Hindu State. She concludes that gender is shaped in and through the discourse of equality, secularism and religion in ways that either compel the 'Other' woman to assimilate into a Hindu nationalist order that is based on a specific conception of gender, or subject her, and her community, to heightened surveillance and regulation should she refuse to comply.

Law and Development: Theory and Practice

The Law and Development Institute, Humboldt University Faculty of Law, and Walter de Gruyter GmbH co-hosted the ninth annual conference in law and development, commemorating the tenth anniversary of Law and Development Review (LDR), currently the only peer-reviewed academic journal in existence devoted to law and development studies. Sixteen leading scholars from North America, Europe, Asia, Africa, and Latin America presented papers on key topics in law and development including the current status of law and development scholarship, the General Theory of Law and Development and its applications, enhancement and protection of economic and social interests, and development governance and the role of development agencies in the development process. Sommerschule/Akademie: "Redistribution and the Law in an Antagonistic World"

The Transregional Academy invited doctoral and postdoctoral scholars from the humanities and social sciences, in particular law, political sciences, political economy, history, anthropology and economy from different countries to present and discuss their current research within an international and multi-disciplinary framework. The Academy is designed to support scholarly networks. The programme will focus on the following themes: 1. (Re-)Distribution and “Development Assistance”; 2. International Conference: The Global South in Comparative Constitutional Law
13.–15. July 2017
From 13. - 15. July 2017 the Journal "Law and Politics in Africa, Asia and Latin America" celebrated its 50th anniversary. To celebrate, the journal hosted an international conference with the title ‘The Global South in Comparative Constitutional Law’ at Humboldt University Berlin. A corresponding book project on »Comparative Constitutional Law and the Global South« will be published in 2020.

Indo-European Workshop Series on "Democratic Constitutionalism in Continental Polities: EU and India compared"
2013–2017
Unter dem Titel "Democracy in Diversity - Indian and European Perspectives" fanden in Kooperation mit IEARN drei Workshop-Seminare statt, in Bangalore (2014), Berlin (2015) und Delhi (2016). Ziel der Workshop-Serie war nicht nur ein Buchprojekt, bei dem die Beiträge jeweils in europäisch-indischer Co-Autorenschaft entstehen („Democratic Constitutionalism in Continental Polities: India and the European Union compared“, Edward Elgar (contract signed, forthcoming 2020), mit Arun Thiruvengadam). Vielmehr will das Projekt darüber hinaus die Forschung zum europäisch-indischen Verfassungsvergleich anregen und auf lange Sicht angelegte Kooperationen zwischen europäischen und indischen Forschungsinstitutionen fördern.
