Die Unterscheidung zwischen Recht und Politik ist zentral für die Moderne. Dabei verweisen Recht und Politik aufeinander und sind strukturell miteinander verflochten. Aber wie genau? Ist alles Recht Ergebnis einer politischen Entscheidung? Ist alle Politik, auch etwa die der verfassungsgebenden Gewalt, rechtlich gebunden? Inwiefern wird Politik durch Recht konstituiert? Welche Konzeption des Politischen ist dem liberal-demokratischen Verfassungsstaat eigen?
