10 648  European Consumer Law

Course (2 SP/SWS) - weekly, Tuesdays from 16:00 to 18:00 (28 April to 30 June 2015)

 

The course focuses on European consumer law. The various consumer protection directives and regulations will be discussed, and their interpretation by the ECJ will be analysed. The lecture will also refer to the implementation of these directives and regulations into German law. The current developments in European consumer law will be considered (in particular the Consumer Rights Directive and the Draft for a Common European Sales Law) and the problems linked to the enforcement of consumer protection provisions will be outlined.

10 647  European and German Unfair Competition Law

Course (2 SP/SWS) - weekly, Tuesdays from 14:00 to 16:00 (28 April to 30 June 2015)

 

The course focuses on unfair competition law that is regulated in the Law of Unfair Commercial Practices (Gesetz gegen unlauteren Wettbewerb, UWG).  At the start, the function of unfair competition law as part of competition law will be taken into account, and consequently the influence of European law on this area of law will be highlighted. Afterwards, the most important key principles will be explained, and various groups of cases will be looked at on the basis of examples of the enforcement of law. Finally, the course is addressed to the enforcement of law.

The seminar focuses on teaching and practicing academic skills, and in particular those relating to legal research and the working up of a topic by means of written argument and oral presentation. The research papers to be submitted by the students are required to be based on recent judgments and scholarly articles concerning US civil law and procedural law.

The seminar primarily serves as a preparation for the research paper in the Schwerpunktbereichsstudium, but it is also offered to all interested students and is recommended for LL.M. students and Ph.D. students.

Examination: research paper (15-20 pages) and presentation (about 20 min)

10 806 Consumer Law in Practice

Lecture series (2 SP/SWS) - weekly, Wednesdays from 18:00 to 20:00 (29 April to 1 July 2015)

 

The lecture series offers practical insights into selected fields of consumer law and involves experienced practitioners from law firms and consumer associations. It will cover not only substantive law, but also procedural law; the alternative dispute resolution will be discussed as well. This lecture series complements the European Consumer Law lecture.

Remark: The attendance at both lectures on consumer law is a prerequisite for participation in the Humboldt Consumer Law Clinic.
