10 644 Green Book European Contract Law - options and consequences

Seminar (2 SWS)

On 1 July 2010 the Green Book "Options for an Introduction of a European Contract law for Consumers and Companies" has been presented. The presentation of the full edition of the draft common frame of reference (DCFR) has been preceding at the beginning of 2009. The Green Book illustrated different options concerning the further development of European contract law in the future. These options constituted e.g. the presentation of a European contract law instruments as a "toolbox" for the legislative authorities as directive or regulation. How shall this statement be assessed? Which consequences will have the individual options on the legal systems of the member states? Will there be a European Civil Code in the future? Are the proposed provisions in the DCFR convincing?

The seminar is dedicated to this topic. The relations of the DCFR to the Acquis-Principles, the Principles of European Contract Law (PECL) and the proposal of a directive on consumer rights as well as the national civil codes – especially the German BGB and the French code civil – shall be assessed.


Group: Students of the specialization 3 and 4b. International students and Ph.D. students are welcome!

Exam: Oral exam/subsequent seminar paper; presentation or seminar paper

Course (2 SP/SWS) weekly, Mondays from 16:00 to 18:00 in room UL 6, 2116
BA BWL and VWL: 3 SP, module Private and Business Law 1 (law 1), audience: first semester of study

The course aims to give an overview over private law. The relevant fields of law for economists (law of obligation, especially contract law) are particularly amplified.


Reading: will be communicated at the beginning of the course.

Exam: Written exam (60 min).
