Workshop and Lecture with Prof. Oren Bar-Gill (Harvard Law School)

Professor Oren Bar-Gill hosts a workshop titled "The Future of Consumer Law" for Ph.D. students and students. He amplipies especially how findings of behavioural economics are applied in the legislation process.

10 681 European Contract Law

Course (2 SWS/ 2 LP) – weekly, Wednesdays, from 14:00 to 16:00, additional date: Wednesday, 20 January 2016 (18:00 to 20:00; BE 2, room E 44/46)

 

European law has an increasing influence on private law. In the first part of the course, the most important conceptual problems are taken into account. The question of what importance European law can have for national private law is highlighted, and we will look at which instruments are used to harmonize the law.

The second part focuses on several areas where the law of obligations has already been harmonized. Different aspects regarding the conclusion of a contract and the law of general terms and conditions and sales law are taken into account. Besides regulations of European primary and secondary law, also reform projects are dealt with, especially the Proposal on a Common European Sales Law (GEK) from 2011. The application and enforcement of European private law aiming to harmonize international private law and national civil procedure law is highlighted, as for instance by the necessity of an autonomous European interpretation of law.

In the third part of the course, principles are presented which shape European contract law through existing European law or through the commonality of all Member States.

10 683 German and European Antitrust Law

Course (2 SWS/ 2 LP) - weekly, Tuesdays, from 14:00 to 16:00

 

The course deals with antitrust law from the national level (GWB) and the supranational level (European competition law). Besides legal considerations, also economic connections are highlighted.
