Ms. Niuscha Bassiri on “Settlement Facilitation in International Arbitration”



On Tuesday, 22. October, Ms. Niuscha Bassiri, Co-Founder of ArbBoutique and one of the leading figures in international arbitration, gave the IDR LL.M. students an opening lecture which marked the start of 2024/2025 guest lecture series.

The topic was “Settlement Facilitation in International Arbitration”. Settlement facilitation mechanisms in international arbitration are needed to decrease costs and delays. Reputable surveys, such as 2021 Queen Mary International Arbitration Survey, reflect the preference of disputant parties for some facilitation and ADR possibilities within international arbitration.

In response to this rising need, many international dispute settlement institutions offer various mediation and facilitation options. For example, the Singapore International Arbitration Centre (SIAC) offers a facilitation process called Arb-Med-Arb, which allows parties to attempt mediation within the arbitration process. However, legal and practical challenges also arise with application of these facilitations within arbitration. During her opening lecture, Ms. Bassiri discussed the importance, challenges, and requirements of settlement facilitation within arbitration with the IDR LL.M. 2024/2025 class. She also drafted and proposed practical model clauses for potential application.
