You have been representing your client in a huge international arbitration case for two years, and now it has come to an end. How does the arbitral tribunal make the arbitral award, and which steps can be taken after the award has been rendered?

For three weeks, IDR LL.M. students focused on these questions. We discussed the making of the arbitral award in its entirety, the termination of the arbitral proceedings, setting aside, recognition, and enforcement of the arbitral award, and tried to come up with solutions on what would be the optimal outcome for the parties both from an arbitrator and a party representative perspective.

On this matter, we have had the opportunity to become the students of Dr. Philipp Wagner (LL.M)., who is a lecturer within the IDR LL.M. programme and the founding partner of Wagner Arbitration, which is one of the leading law offices in international arbitration in Berlin.

Dr. Philipp Wagner (LL.M.), not only taught us the very basics of the topics and the rationale underlying but also guided us on how to interpret the articles of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Furthermore, we had the chance to compare various domestic arbitration laws as well, such as the English Arbitration Act, the German ZPO, the Swiss Law on Private International Law, the French Code of Civil Procedure, and the Belgian Judicial Code.

It can easily be said that after the arbitration modules, every single IDR LL.M. candidate has a deep understanding of how to prepare an arbitral award and post-award stage procedures, and is capable of drafting an award as an arbitrator or challenging or applying for the enforcement of the award as a party counsel.
