The class of 2022/2023 of the IDR LL.M. program had the opportunity to study the intricacies of arbitrations administered by the German Arbitration Institute (Deutsche Institution für Schiedsgerichtsbarkeit – DIS) as part of the Specific Areas of Arbitration module. The lectures on “Introduction to DIS” were delivered by Meike von Levetzow, Rechtsanwältin (Lawyer), certified specialist in banking and capital markets law and partner at the law firm Noerr.

Meike is a member of the DIS Advisory Board and was an arbitrator in numerous proceedings under the rules of the DIS, ICC, SCC, FAI and ad hoc (co-arbitrator, sole arbitrator, and chairperson), as well as a party representative in numerous national and international arbitration proceedings under the rules of the ICC, DIS, LCIA, and SCC. Thus, the class received more than just theoretical knowledge about the DIS Arbitration Rules because Meike also shared comprehensive insights from a practical perspective and encouraged the class to consider procedural aspects from the point of view of the parties’ counsel and/or arbitral tribunal.

Among other things, together with Meike, we discussed the start of an arbitration under DIS Rules, the selection of arbitrators and challenge procedure, conduct of proceedings and ways to end it, as well as costs in DIS arbitration. We also discovered the special DIS Rules concerning expedited proceedings, mediation, expert determination, adjudication, dispute management proceedings, and corporate disputes.

Every lecture was aimed at conveying practical skills, so the class had an opportunity to acquire them while resolving small cases or scenarios.

Since our class consists of students coming from jurisdictions other than Germany, the possibility to find out more about the DIS was extremely interesting to us. Now, we look forward to implementing the knowledge we acquired in our future practice!
