Arbitration

The module Arbitration introduces the students to the legal basics of (international) arbitration law, while also granting practical insights for application. The focus of the module is on international commercial arbitration. It consists of two units: Arbitration I and Arbitration II.

The lecture Arbitration I explores the main features of international arbitration. In this context, arbitration agreements, standard arbitration clauses and the applicable law will be discussed. Participants will also get to know the world's major arbitration rules, in particular UNCITRAL, ICC, DIS, LCIA, AAA, CIETAC, SEAC, Swiss Rules and the Stockholm Rules. In doing so, the students gain abstract insights as to the common problems and solutions of these frameworks. Finally the arbitral award will be discussed.

The lecture Arbitration II is especially devoted to the remedies against arbitration awards and their enforcement. The students learn the requirements and common principles of multiple national and international legal frameworks, dealing with issues like the setting aside of arbitral awards, the recognition and enforcement of arbitral awards or interim relief.

 

The module is completed with a written examination.
