On Wednesday, May 8, at 6 p.m., Prof. Dr. Clemens Höpfner ( University of Cologne) will speak on “Is our industrial action law still up to date?” at the Kammergericht Berlin (Plenarsaal) at the invitation of Juristische Gesellschaft zu Berlin. On the subject:
Collective labor disputes are a necessary part of the economic order. Ideally, however, the parties involved in collective labor agreements reach an agreement without resorting to industrial action. In the meantime, industrial action has clearly moved away from this ideal situation. In recent years, the severity and duration of collective disputes has increased in Germany. There is an increasing frequency of widespread strike action, often at an early stage in collective bargaining disputes. This is problematic not least because industrial action causes damage not only to the employers directly affected by the action, but also to uninvolved third parties and the general public, for example in the case of strikes in the transport sector. Against this backdrop, Prof. Dr. Clemens Höpfner will examine the question of whether the current law on industrial action, which is shaped by the courts, is still fulfilling its functions and what measures should be taken by lawmakers.

 

About the speaker:
Prof. Dr. Clemens Höpfner studied law at the University of Konstanz. After completing his doctorate supervised by Prof. Dr. Dres. h.c. Bernd Rüthers and his legal clerkship at the Higher Regional Court of Karlsruhe, he habilitated under Prof. Dr. Martin Henssler at the long-established Cologne Institute for Labor and Commercial Law. From 2015, he held the Chair of Civil Law, Labor Law, Corporate Law and Legal Theory at the University of Konstanz. In 2017, he took over the management of the Institute for Labor, Social and Economic Law at the University of Münster. Since April 2022, he has been Managing Director of the Institute for Labor and Business Law at the University of Cologne. Clemens Höpfner is the author of numerous publications on labor law and civil law, managing editor of the journal “Recht der Arbeit”, co-editor of the “Zeitschrift für Arbeitsrecht”, several labor law series and the BeckOGK on termination law.
