Juristische Gesellschaft zu Berlin: Lecture by Clemens Höpfner on May 8

On Wednesday, May 8, at 6 p.m., Prof. Dr. Clemens Höpfner ( University of Cologne) will speak on “Is our industrial action law still up to date?” at the Kammergericht Berlin (Plenarsaal) at the invitation of Juristische Gesellschaft zu Berlin. All interested participants are cordially invited to attend!

On the subject:
Collective labor disputes are a necessary part of the economic order. Ideally, however, the parties involved in collective labor agreements reach an agreement without resorting to industrial action. In the meantime, industrial action has clearly moved away from this ideal situation. In recent years, the severity and duration of collective disputes has increased in Germany. There is an increasing frequency of widespread strike action, often at an early stage in collective bargaining disputes. This is problematic not least because industrial action causes damage not only to the employers directly affected by the action, but also to uninvolved third parties and the general public, for example in the case of strikes in the transport sector. Against this backdrop, Prof. Dr. Clemens Höpfner will examine the question of whether the current law on industrial action, which is shaped by the courts, is still fulfilling its functions and what measures should be taken by lawmakers.
